Die neuzeitliche Naturrechtstheorie benötigt keine Einsicht des Gewissens mehr. Nicht mehr das Gute und Richtige ist vorrangig, sondern lediglich die Möglichkeit eines gemeinsamen Rechtfindungsprozesses, der Recht und Gesetz kommunikativ und argumentativ ausbildet. Das wird bestärkt durch den #Relativismus, der ohne Wahrheit Gesetzlichkeiten festlegen muss, um auf dem geringsten oder einem ideologischen Nenner eine Gesellschaft zu organisieren. Nicht mehr das Unmittelbare, die Wahrheit, die Notwendigkeit anhand der Realität, sondern das Prozedurale formt die Auseinandersetzung.
