合衆国最高裁判所は2月20日、トランプ米大統領が1977年の国際緊急経済権限法（IEEPA）に基づき、議会の承認なく関税を発動することは、大統領権限を逸脱しているという下級審の判断を支持しました。同法が関税措置を発動する権限を与えているというトランプ政権の主張は、議会の権限を侵害し、法的原則に違反すると判断しました。判決は6対3です。リベラル派とされる判事3人に加え、ジョン・ロバーツ長官とトランプ大統領が1期目に任命した保守派のゴーサッチ判事とバレット判事が違法と判断しました。
