Bluesky has halted service in Mississippi due to a new age verification law, saying they don't have the resources to comply (link below). Based on their statement and my superficial reading of the law, it sounds like failure to verify ages would be "AN UNFAIR AND DECEPTIVE TRADE PRACTICE THAT IS ENFORCEABLE BY THE OFFICE OF THE ATTORNEY GENERAL", with fines of up to $10k per user.
My thoughts:
1. Do we hope Mastodon avoids notice due to the small size of each provider? In favor of that strategy, the SCOTUS stated that the law is likely unconstitutional, so this threat will likely only exist for a short period of time. "enforcement of the Mississippi law would likely violate its members’ First Amendment rights under this Court’s
precedents." I also wonder about the application of the interstate commerce clause -- can they really insist that out-of-state providers change their practices to conform with these impositions from MS?
2. The law seems to be focused on the ability to make (semi-)public posts; if something like this were to go into effect, would there be value in offering a 'read only' account to people in the affected jurisdiction? Most users of large platforms are lurkers anyway.
3. Given the recent open politicization of social media platforms, I wouldn't trust this law to be applied fairly, and I would view it as straight-out censorship of non-Republican voices.
